Commercial Motor Vehicle Defense
If you are a professional driver, then you know your safety record is everything. Your driving transcript can affect how much insurance you pay, your employability, and even your ability to obtain a commercial driver’s license. Whether your job requires a CDL or not, traffic infractions can impact a professional driver’s ability to earn a living. Every ticket counts.
Experience in the Field is Crucial
Waldman & Associates can help. Our traffic defense attorney, Jamie Walker, was once one of the dreaded “DOT men” in the Fredericksburg area. Certified in 2007 as a Level One Federal Motor Carrier Inspector, Attorney Walker knows what inspectors are looking for in a 32-point roadside inspection. For over eight years he worked with local and state agencies to identify unsafe trucks and remove them from service due to a sound knowledge of the Code of Federal Regulations, the Code of Virginia, and Federal Motor Carrier Out-of-Service Criteria.
Walker has experience enforcing regulations for motorcoaches, long-haul tractor-trailers, and local route vehicles. Let his experience work for you, whether it is a standard speeding violation in a commercial vehicle, a logbook discrepancy or an overweight violation, he has seen it in the field and in the courtroom. More importantly, all of his experience is local: Stafford, Fredericksburg, Spotsylvania, and even Culpeper
Overweight Violations
Can Break the Bank
Violations in a commercial vehicle are also expensive. Overweight violations can happen on any highway—even those without scales. The Virginia Department of Motor Vehicles deploys multiple portable scale crews across the Commonwealth each day. If you are issued an overweight citation, you only have 21 days to notify DMV of your dispute before a default judgment is issued against the carrier. These citations are pricey, often exceeding $10,000. In Fredericksburg, multiple carriers have been held liable for overweight violations with liquidated damages exceeding $25,000. We can help you.
Let Us Fight the DOT for You
Moving violations and federal motor carrier safety violations can hurt your company’s safety rating with the Federal Motor Carrier Safety Administration. The lower your rating, the more likely your trucks are to be inspected. While it is best to try to avoid violations, you should try to protect your record from the most serious of them
